Code of conduct for student recruitment representatives
Part 1: Compliance requirements
Representatives are required to comply with all the following:
- Comply with ACAS and WU policies and procedures for program admissions. This includes but is not limited to:
- treating prospective students equitably and non-prejudicially according to the access policies of ACAS and the anti-discrimination policies of WU.
- maintaining confidentiality of all student information.
- verifying identities of applicants.
- Getting ACAS and WU approval for all advertising literature.
- Enhance the reputations of WU and ACAS
- Allow WU and ACAS to monitor their activities:
- Disclose all information to WU and ACAS
- Report to WU and ACAS at least six monthly and at other times when asked.
- Provide feedback to ACAS and WU in order to better improve services.
- Clearly identify WU and ACAS as program providers and provide prospective students with WU and ACAS contact information.
- Prospective students retain the right to contact WU and ACAS directly.
- Representatives may not attempt to hinder or prevent prospective students from contacting ACAS or WU.
- Deal honestly with WU, ACAS, potential students and admitted students at all times.
- The information of ACAS and WU courses provided by representatives to prospective students must be accurate.
- Representatives must support the interests of WU and ACAS without conflict of duty to any other educational institution as a recruiter.
- Verify the identities of applicants.
- Act in the best interests of prospective students. This includes, but is not limited to:
- Providing honest advice
- Recruiting only suitably qualified prospective students who have the ability to benefit from the proposed course.
- Giving applicants a ten-day cooling off period after making an application, and
- Giving applicants who choose to withdraw a full refund of all funds paid.
- Give admitted students after-sales service until such time as students participate in orientation for new students. Examples of after sales services include:
- answering inquiries and
- smoothing the transition from admission and enrollment to the beginning of studies.
- Maintain the role of fit and proper person.
- Comply with any governmental laws and regulations applicable at the time.
- Inform WU and ACAS of any legislation and other government regulations relevant to the programs at the time.
Part 2. Other regulations
- Representatives may not:
- Exert undue pressure on prospective students to apply.
- Ask for or accept money or other benefits from prospective students or applicants other than those authorized by ACAS and WU.
- Offer inducements to apply.
- Incur debts on behalf of ACAS or WU
- Make undertakings of any kind whatsoever on behalf of ACAS or WU other that those authorized in writing by WU or ACAS.
- Subcontract services to other parties.
- Operate outside his/her/its defined region(s).
- Endanger in any way whatsoever the registration of ACAS as a Registered Training Organisation or any other accreditations held by ACAS or WU.
- Representatives will not be paid for discontinued enrollments under any circumstances. "Discontinued enrollments" are students who apply but do not commence studies for whatever reason (e.g. non-payment of fees, failure to submit all application requirements).
- ACAS and WU will own absolutely the intellectual property rights to any advertising materials and other materials produced pertaining to student recruitment.
- WU and ACAS will retain the responsibility for making all representations government agencies should the need arise, except where the representative is specifically authorized.
- ACAS and WU will provide all current information necessary for compliance with the above in a useful form on all matters relating to provision of recognised courses.
- ACAS will normally provide information and advice to member colleges though the ACAS website and email.
- Other channels of communication will vary from time to time and according to need, and include consultancy visits, telephone.
- ACAS gives no guarantee of any kind whatsoever pertaining to the accuracy of any advice where information is not publicly disclosed by the relevant government department.
- The existence of alternative professional opinion will not be deemed evidence that any advice given by ACAS is incompetent or negligent.
- Notices will ordinarily be given in the first instance by electronic mail.
- A written notice required or permitted under this code or agreement from one party to the other party will be deemed to have been duly given on the third day after mailing by ordinary post if mailed to the party at the most recent address given by written notice.
